1. Who these terms are with
This website is operated by SmartCare Living (the “Company”, “we”, “us”), Dublin, Ireland. By using the site you agree to these Terms of Use, our Privacy Policy and our Cookie Policy. If you do not agree, please don't use the site.
2. Accuracy of information on the site
We try to keep all information on smartcareliving.ie accurate and up to date, but we don't guarantee it. Pages may go out of date, prices change, products evolve. Anything you read here is for general information — specific quotes, recommendations and contractual commitments only happen during a booked consultation or in writing.
Nothing on this website constitutes medical, legal, financial or care advice. SmartGuardian is not a medical device — please review our disclaimer for the regulatory framework.
3. Using the website
You agree not to:
- Use the website in any way that breaches any applicable law (Irish, EU or otherwise)
- Submit a contact form, assessment or booking with someone else's contact details without their permission
- Try to gain unauthorised access to the site, servers, databases or any third-party systems we use
- Run automated bots to scrape, harvest, copy or republish our content
- Send spam, malware, exploits, or content that is defamatory, obscene, harassing, threatening, infringing or otherwise unlawful
- Use the site to compete with us, including reverse-engineering our services or pricing for a competing offer
4. Lead form, assessment quiz, booking widget
When you submit any form on this site (contact form, 2-minute assessment, callback booking, consultation booking, emergency callback) you confirm:
- The details you provide are accurate and yours, or you have permission to provide them on someone else's behalf
- You're 18 or older
- You're happy for us to follow up by phone, email or SMS in connection with that specific enquiry
Submitting a form does not create a contract for the supply of any product or service — that happens later, in writing, after a consultation. We reserve the right to decline any enquiry, especially if we cannot serve your area, the service isn't a good fit for the household, or we suspect the submission is automated.
5. Intellectual property
All content on smartcareliving.ie (text, photos, illustrations, the SmartCare Living and SmartGuardian names, logos, page layouts, software code) is owned by SmartCare Living or its licensors. It's protected by Irish and EU copyright, trade-mark and unfair-competition law.
You may:
- View pages on a personal device for personal, non-commercial use
- Print or save individual pages for your own reference
- Share links to our pages on social media or by email
You may NOT, without our prior written permission:
- Reproduce our content on any other website, app or printed publication
- Modify our logos or graphics
- Use our brand or content for commercial purposes
- Frame the site within another site or strip our branding
6. Third-party links
We sometimes link to third-party sites (HSE, Citizens Information, Data Protection Commission, etc.) for your convenience. We don't control those sites and aren't responsible for their content, accuracy or privacy practices. Visiting them is at your own risk.
7. Service availability
We aim to keep the site up 24/7 but don't guarantee it. We may suspend, withdraw or restrict any part of the site for maintenance or any other reason without notice. We're not liable to you if for any reason the site is unavailable at any time or for any period.
8. Limitation of liability
To the maximum extent permitted by Irish law:
- The website is provided “as is” without warranties of any kind
- We're not liable for any loss of profit, revenue, business, goodwill, anticipated savings or data arising from your use of the site
- We're not liable for any indirect, consequential or special loss
- For any liability we cannot exclude, our total liability arising from website use is capped at €100
Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded under Irish law (including statutory rights of consumers under the Consumer Rights Act 2022 and the Sale of Goods and Supply of Services Act 1980).

We may update these terms from time to time. The “Last updated” date at the top of the page reflects the most recent version. By continuing to use the site after a change you accept the updated terms. If you don't agree, stop using the site.
11. Governing law & jurisdiction
These terms, and any non-contractual obligations connected with them, are governed by the laws of Ireland. The Irish courts have exclusive jurisdiction. This does not deprive any consumer of rights under the law of their habitual residence where mandatory consumer-protection rules of that jurisdiction apply.
